This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, requiring the publication of the rules, regulations, privacy policy, and Terms of Use for access to or usage of the domain name https://kavyatva.com/ (“Website”), including any related mobile sites and mobile applications (“Platform”).

The Platform is owned and operated by KAVYATVA, a company incorporated under the Companies Act, 1956 with its registered office at 18, Kalamma Rd, Ramaswamipalya, Lingarajapuram, Bengaluru, Karnataka 560033 (hereinafter referred to as “Platform Owner”, “we”, “us”, “our”).

By using the Platform, you (“you”, “your”, or “User”) are deemed to have read, understood, and agreed to be bound by these Terms and Conditions (“Terms of Use”) and the associated policies referenced herein. If you do not agree to these Terms, you must not use this Platform.

1. User Eligibility

You must be legally competent to enter into a binding contract under Indian laws. If you access or use the Platform, you represent that you meet this requirement.

2. Services and Platform Usage

  • You agree to provide accurate, complete, and updated information during and after registration on the Platform.

  • Unauthorized use of the Platform, including unauthorized access, hacking, and data mining, is strictly prohibited and may attract legal action.

  • You agree not to use the Platform for any purpose that is unlawful or prohibited under these Terms or applicable laws.

3. Intellectual Property Rights

  • All content on the Platform, including but not limited to text, graphics, logos, images, audio clips, video clips, and data compilations, is the property of the Platform Owner or its licensors and is protected by intellectual property laws.

  • No part of the Platform may be reproduced, duplicated, copied, sold, resold, or exploited for any commercial purpose without express written consent.

4. Pricing and Payment

  • Prices for products and services are subject to change without prior notice.

  • You agree to pay all charges associated with purchases made through the Platform.

5. Shipping and Delivery

  • All products are shipped within 6 to 15 working days, excluding Sundays and government holidays.

  • As all products are handcrafted, slight delays may occur to maintain quality standards.

  • Kavyatva is not liable for any delivery delays caused by unforeseen circumstances beyond our control.

6. Refund and Replacement Policy

  • Refunds are NOT issued unless the product is received with a proven manufacturing defect.

  • If a product has a manufacturing defect, the customer must notify us within 48 hours of receiving the product along with appropriate proof (images/videos).

  • Upon verification, either a replacement will be provided, or a refund will be issued at our discretion.

  • No returns or refunds are applicable for reasons such as change of mind, slight color variations, or minor imperfections which are natural in handcrafted products.

7. Limitation of Liability

Your use of the Platform and our services is solely at your own risk. The Platform and all services provided through it are provided “as is” without any warranty of any kind, either express or implied.

8. Indemnity

You agree to indemnify and hold harmless the Platform Owner and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform or your violation of these Terms of Use.

9. Force Majeure

We shall not be held responsible for any failure or delay in the performance of our obligations due to events beyond our reasonable control, including acts of God, pandemics, natural disasters, war, terrorism, labor strikes, or government actions.

10. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka.

11. Modifications

We reserve the right to modify these Terms of Use at any time without prior notice. It is your responsibility to periodically review the Terms to stay informed of updates.
